The Appellate Division has suspended the High Court's directive that ordered the establishment of an independent secretariat for the Supreme Court within three months. A four-member bench led by Chief Justice Zubair Rahman Chowdhury issued this order on Tuesday following an appeal filed by the state. The High Court had previously declared Article 116 of the Constitution to be in conflict with the fundamental principles of the Constitution during a verdict delivered on September 2, 2023. In addition to the state's appeal, the court also considered separate petitions submitted by Supreme Court lawyer Ahsanul Karim and SHUJAN secretary Badiul Alam Majumdar. The Appellate Division has scheduled the formal hearing for these appeals to take place on June 16. Until the final disposal of these appeals, the implementation of the High Court's ruling remains stayed.

The case is significant as it challenges the constitutionality of Article 116 and addresses the long-standing debate regarding the administrative independence of the judiciary from the executive branch.
