The Attorney General's Chambers has argued that the Malaysian Bar Council failed to demonstrate any violation of the Judicial Appointments Commission Act (JAC) concerning the appointment of Federal Court Judge Tan Sri Ahmad Terrirudin Mohd Salleh to the JAC. Representing the Attorney General, Senior Federal Counsel Shamsul Bolhassan contended that Ahmad Terrirudin met the statutory requirements for JAC membership, specifically being a Federal Court Judge appointed by the Prime Minister. He further argued that Ahmad Terrirudin, as one member among many, could not unilaterally influence judicial appointments, as the JAC only provides recommendations while the ultimate appointment power rests with the King on the Prime Minister's advice.
This case is significant as it addresses the legal validity of judicial appointments and the role of the Judicial Appointments Commission in ensuring transparency and adherence to the law.
