The Federal Supreme Court (STF) has overturned a prior ruling against the pharmaceutical company Eli Lilly do Brasil. The company had been ordered to pay significant damages, including a lifetime pension and medical expenses, due to alleged toxic exposure of an employee that resulted in congenital malformations in his daughter. The initial conviction, upheld by the Superior Labor Court (TST), stemmed from the daughter's birth defects, including spina bifida and hydrocephalus, in 1994.
However, the STF's First Panel ruled that the Labor Court lacked jurisdiction to hear the case. Justice Flávio Dino argued that the claim was brought by a third party, the employee's daughter, seeking her own rights, which falls outside the scope of labor law concerning workplace accidents. The case will now be sent back to the TST for a new decision.
This decision shifts the legal venue for claims brought by dependents of employees against employers, potentially impacting how such cases are adjudicated in Brazil.
