The High Court has temporarily reinstated two members of the Keetmanshoop municipality management committee after suspending the implementation of a council resolution that removed them from office. This comes after the court interdicted the Keetmanshoop Municipal Council, its management committee and other respondents from implementing resolutions adopted on 7 May and 4 June, through which a vote of no confidence was passed against the two councillors, leading to their removal from the management committee. Judge Thomas Masuku on Monday granted an urgent court order in favour of Landless People’s Movement councillor Easter Isaak and Annelize Knaus, restoring them to their positions pending the final determination of the main application. The order further bars the municipality from facilitating or proceeding with the swearing-in of any newly appointed management committee members arising from the disputed resolutions. “Isaak and Knaus must immediately be restored to their seats on the management committee, with the ruling remaining in force until the court hears and decides part B of the application, which seeks a review of the council’s decisions,” reads the court order. The court also condoned the applicants’ non-compliance with procedural requirements and agreed to hear the matter on an urgent basis. Costs relating to the urgent application were reserved for determination together with the respondents in the matter which include the Keetmanshoop Municipal Council, the municipality’s management committee, the acting chief executive, several councillors, the minister of urban and rural development and the Keetmanshoop magistrate. The matter has been removed from the urgent court roll pending the final determination of the main review application.
