This landmark decision rectifies a grave miscarriage of justice after new evidence proved his innocence. Toummouhi was convicted in 1992 and imprisoned until April 2009. Crucial biological evidence indicating his innocence was not adequately considered during his trial. Years later, DNA analysis revealed the semen found belonged to another man with a similar appearance. In June 2023, the Supreme Court overturned the conviction, citing conclusive scientific evidence. Toummouhi sought €3.6 million for state liability, but his initial claim was rejected.
