Eastern Cape Premier Oscar Mabuyane’s urgent court bid to have EFF leader Julius Malema’s claims that he “stole” a master’s degree from the University of Fort Hare declared unlawful and false has been dismissed with costs.
Mabuyane also wanted Malema to be restrained or interdicted from making or publishing statements that imply that he “stole” or fraudulently obtained a master’s degree at the university.
Judge Johannes Eksteen on Tuesday found that while every person has the right to be protected against unlawful attacks on their dignity and reputation, there is no right to be protected against lawful criticism once the defence of truth and public interest is established.
