A new analysis of family court decisions in England and Wales has identified systemic patterns of bias and victim-blaming that disproportionately affect women. The research examined 91 judicial rulings and found that nearly three-quarters contained elements of victim-blaming language or reasoning. Mothers appearing in family court proceedings face heightened scrutiny compared to other parties, according to the findings. The report, titled Scratching the Surface: Victim-Blaming and Bias in Family Court Judgments, was produced by the advocacy group Right to Equality. The organization plans to present its conclusions to members of parliament during a parliamentary event scheduled for Tuesday.
The findings raise concerns about whether family court systems are delivering fair outcomes for women and mothers involved in custody and related disputes.
